Sun SoftWash Terms & Conditions of Service

These Terms & Conditions (“Terms”) apply to the exterior cleaning services (“Services”) provided by Sun SoftWash (“we,” “us,” or “our”) to you, the customer (“you” or “your”).

By engaging our Services, you agree to these Terms. This document outlines the agreement between you and Sun SoftWash regarding our Services.

1. Client Obligations

1.1 Access to Property

You grant Sun SoftWash access to your property on the agreed date and time to perform the Services.

1.2 Water Supply

You agree to provide an accessible clean water supply to allow us to complete the cleaning process.

1.3 Property Integrity

We are not responsible for any water infiltration due to improperly sealed windows, broken cladding, defective construction, wood rot, or other structural issues. Please ensure your property is weathertight. We are also not liable for any damage caused by previous work or poor workmanship in any areas that we clean.

1.4 Safety

For safety reasons, you must ensure that you, your employees, children, pets, and other individuals remain clear of the cleaning area during the service.

1.5 Vegetation

We cannot clean areas that are obstructed by heavy vegetation or other obstacles. Please ensure that the area is clear before the service.

1.6 Window Cleaning

Windows will be foamed, brushed, and rinsed during our soft wash service. Some water spotting may occur as a result of the cleaning process.

1.7 Heavy Stains

Properties with exceptionally heavy dirt, moss, mold, or vegetation growth may require additional scrubbing, which may incur extra charges.

1.8 Moveable Furniture

We recommend that all unattached furniture and items be moved away from the cleaning area. If we are required to move items, additional charges may apply. While we take great care, we are not responsible for any damage to items moved by our team.

1.9 Stains

Some stains, particularly stubborn ones, may not be removable using our cleaning process. We will inform you of any stains that cannot be removed.

1.10 Allergies

Please notify us in advance if anyone on the property has any allergies to cleaning products so that we can take appropriate precautions.

1.11 Rainwater Tanks

If you collect rainwater, we advise disconnecting your rainwater tank from the gutter before the roof treatment. We recommend waiting at least six rainfall events before reconnecting your rainwater tank to ensure that all chemicals are washed away safely.

2. Payment

2.1 Payment Terms

A deposit is not required upon booking confirmation. Full payment is due within three (3) days of the invoice date, unless otherwise agreed upon in writing. Late payment will result in additional fees.

2.2 Responsibility for Payment

You agree to make full payment by the due date. If payment is not made on time, additional charges may apply.

2.3 Late Payment

If payment is not made by the due date, we reserve the right to charge a late fee of [specify amount] or pass your account to a third-party collection agency, with you being responsible for any collection costs, including legal fees.

2.4 Non-Payment

If your payment is not made within the agreed period, you will remain liable for all costs associated with the Services provided up to that point, and further services may be suspended until payment is received.

3. Limitation of Liability

3.1 Liability for Damages

Our liability for any loss, damage, expense, or economic loss (including consequential loss) arising out of or in connection with the Services is limited to, at our discretion, redoing the work, remedying any damage, or providing a refund for the affected services.

3.2 Altered Work

We will not be liable for any loss or damage if the work has been altered or repaired by any third party.

3.3 Failure to Perform Services

We will not be liable for any loss or damage due to the inability to provide services as a result of:

  • No water available on site
  • Inability to access the property
  • Events outside of our control, such as weather or force majeure events

3.4 Pre-existing Damage

We are not liable for any damage to paintwork, surfaces, or any other area if the surfaces were not properly maintained or have pre-existing issues such as poor sealing, cracks, or other damage.

4. Acceptance of Terms

4.1 Agreement to Terms

By accepting our quote, placing an order, or scheduling a service, you are deemed to have accepted these Terms and Conditions.

5. Service Variations

5.1 Request for Variation

If you request a variation to the scope of services, additional charges may apply. Any changes to the agreed scope must be agreed upon in writing.

5.2 Inaccuracies

If the information you provided to us is incomplete or inaccurate, resulting in extra work, additional charges may apply.

6. Your Indemnity

6.1 Indemnification

You agree to indemnify Sun SoftWash for any loss, damage, or legal expenses arising from a breach of these Terms, or due to actions or omissions by you or your personnel.

7. Health and Safety

7.1 Compliance

Both parties agree to comply with the Health and Safety at Work Act 2015 (HSWA) and any relevant safety guidelines related to the performance of the Services.

7.2 Hazards

You agree to notify us of any hazards or risks that may affect the safety of our personnel. This includes potential hazards like electrical systems, structural issues, or any areas where cleaning might present a risk.

8. Force Majeure

8.1 Unforeseen Events

Neither party will be liable for delays or failure to perform services due to Force Majeure events, including, but not limited to, natural disasters (e.g., floods, hurricanes), pandemics, civil unrest, government restrictions, or any other event outside of reasonable control.

9. Privacy

9.1 Data Usage

We may collect and use your personal information to provide our Services, process payments, and communicate with you. We do not share your personal information with third parties except as required by law or for business operations related to service provision.

9.2 Right to Access

You have the right to request access to the personal information we hold about you, in accordance with the Privacy Act 2020.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of New Zealand, and any disputes will be resolved in New Zealand courts.

10.2 Dispute Resolution

In the event of a dispute, both parties agree to first attempt to resolve the matter through mediation. If mediation is unsuccessful, the dispute will be resolved in the appropriate courts of New Zealand.

11. General

11.1 Modifications

Sun SoftWash reserves the right to modify these Terms at any time. Any changes will be communicated to you, and by continuing to use our services, you agree to the updated Terms.

11.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, it will be modified to the extent necessary to make it valid and enforceable, without affecting the validity of the remaining provisions.

11.3 Entire Agreement

These Terms constitute the entire agreement between the parties and supersede all prior agreements or understandings.
